ImmersionLighting.com Terms and Conditions
The use of www.ImmersionLighting.com (the “Site”) is governed by the policies, terms and conditions set forth below. Please read them carefully. By using this Site, you (“you” or “Website User”) agree to the terms and conditions in this Agreement between you and ImmersionLighting.com (hereinafter, “ImmersionLighting.com “). If you do not agree to these outlined terms and conditions (the “Terms of Use” or “Agreement”), your only recourse is to discontinue use of the Site, including ceasing making purchases through the Site.
ImmersionLighting.com reserves the right to make any changes to these Terms of Use and/or our Privacy Policy (which is incorporated herein by reference) without prior notification to you.  You should re-read this Agreement containing the Terms of Use and Privacy Policy from time to time in order that you stay informed as to any such changes.  If we make changes to our Terms of Use and Privacy Policy and you continue to use our Site, including making purchases through the Site, you are impliedly agreeing to the Terms of Use and Privacy Policy expressed herein.  We strongly suggest that each time you make a purchase through this Site, you re-read the Terms of Use.

Use of the Website
By accessing the website, you warrant and represent to ImmersionLighting.com that you are legally entitled to do so and legally able to enter into contracts for the purchase of items herein on behalf of you and any business that you represent.
Ordering
We strive to provide an easy and secure ordering process for you.  We provide a one-page checkout in which you can fill out all your information efficiently and quickly.  It is your responsibility to ensure the accuracy of all information that you submit. We will communicate with you at the phone number and/or email address provided if there are any issues with your order. You will be emailed an order confirmation when you place the order to the email address that you registered with.
Updating Account Information and Viewing Orders
You can view your account information and orders at any time by logging in with the email and password you created with us during your first order.  You may click on “My Account” or “Log In” in the top menu.  The first page is “My Dashboard” in which you can view your current and past orders and contact information.  Other information regarding your account can be found on the left side menu.
Refusal of Service
We reserve the right to refuse to process an order for any reason or to limit the order quantity on any product or service. Your order confirmation is an offer to buy, not a completed sales contract. Order acceptance and the completion of the contract between us will take place on the shipment of the products ordered. We reserve the right at any time after the receipt of your order to cancel your order for any reason. If the order is cancelled, the authorization on your card will be voided and no money will be charged. If your card has been charged, a refund will be issued to your credit card.
Product Information
Our online catalog is provided as a convenience to you. We do not warrant that the product descriptions are accurate, complete, reliable, current, or error-free.  We reserve the right to correct any typographical errors, inaccuracies, or omissions that may relate to product descriptions, pricing, and availability from time to time without prior notice.  We have made every effort to display as accurately as possible the colors of our products that appear on our Site.  We cannot guarantee that your computer monitor’s display of any color will be accurate, complete, reliable, or error-free.  Although we try our best effort to maintain an error-free website, a small number of the parts in our catalog may be mispriced or the case number may be inaccurate. If the correct price is lower than the listed price, we will invoice you for the lower amount and ship out the order. If the part’s correct price is higher than our listed price, we will inform you first to see whether the order should be proceed or canceled. We apologize for any inconvenience.
“ImmersionLighting FAQ’s” is provided as a standard guide to you on use, guidance, and information of the product.  ImmersionLighting.com is not liable for any misrepresentation of information in this section. The information represented in this section is opinion only, and cannot be construed as official technical information regarding products.  If official information is needed, please refer to the manufacturer’s spec sheet.  Manufacturer’s spec sheet information is the only official information we provide and we are not held accountable for typo and information errors in our product listing.
Payment, Pricing & Promotions
We respect your privacy and do not release your information for any reason except if required by law or required due to a dispute for payment or shipping. We use a dedicated SSL certificate to encrypt and secure all online orders.  For security reasons, all credit cards are processed by third parties. We have partnered with third parties, including Paypal & Square, to provide you with the most secure and trusted payment systems available.  Please refer to the site that is processing your payment for information regarding the use of any personal information you submit through its site.  In addition to payments via the web, we also take check or money order sent to our headquarters. Payment by check or money order may delay shipment of your order as all checks and money orders will be verified and deposited before the order ships.
Sales Tax
Sales tax will be calculated on all orders shipped to Oklahoma addresses.  The exact calculated amount depends on the city, county, and state of the address. If you are purchasing items to resale, please contact us for instructions to remit your Tax Exemption Certificate prior to sale. In some cases, ImmersionLighting.com is required to remit sales tax on items sent to you even if you are located outside of Oklahoma by the manufacturer of products sold through ImmersionLighting.com.   If this occurs, you agree that you will be charged the sales tax and that it may increase the cost of your order, even if it has already been placed.  If you are outside Oklahoma and sales tax is not collected on your order, you agree and acknowledge that it is your responsibility to remit applicable taxes to the state you are located in.
Backorders
In the event of a backordered parts, we will inform and give you the option to cancel the order. If you are willing to wait, the paid order will stay in the system and remain submitted until the order has been shipped.
Shipping Information
We ship to the 48 contiguous United States. Most of the orders are processed and shipped out within 1-3 business days. All estimated lead times are listed in the Specifications section of each product page, and may vary based on current backlogs, stock levels, or other outside variables. All orders must be shipped; pick-up services are not offered. Please ensure that all shipping information you have provided to ImmersionLighting.com is correct as you will be responsible for any additional costs incurred if the shipping information you have provided is incorrect and shipments have to be rerouted.
Daily shipping deadlines vary by product and manufacturer.  All Next Day, 2 Day and 3 Day orders must be placed before 12:00 PM MST in order to be shipped that same day, provided that the products are in stock.  All orders placed after 12:00 PM MST will ship the next business day, provided that the products are in stock. A tracking number will be emailed to you as soon as the shipping department provides it. There may be a 1-2 day delay in providing the tracking number based on volume.
It is your responsibility to unload the product from freight shipments.  ImmersionLighting.com provides free shipping on large orders but will not procure the services to unload product.  Where available, we provide information about the necessary equipment to large shipments, which may include the need to use heavy equipment to unload products. Any charges incurred by you to unload product or due to delay in unloading the products will be your responsibility.
We are pleased to currently offer free ground or freight shipping on orders over $1,000 shipped to the contiguous 48 states. Should you request a shipping method other than ground or freight shipping, additional costs may apply.
If you are outside of the contiguous United States, including, but not limited to shipments to APO, FPO, and P.O. Box addresses, Alaska, Hawaii, Guam, Puerto Rico, Virgin Islands, and to international addresses, please contact us for assistance on ordering. For orders outside the lower 48 states, shipping charges are calculated on the total weight of the order at the time of purchase.
Damaged Products
Shipping damage may occur.  Please immediately inspect all orders before signing off with the shipping company. You must refuse any orders that show obvious signs of damage at delivery. If you need to return the order due to shipping damage that was not visible at the time of delivery, please call us immediately. ImmersionLighting.com is not responsible for any damage that is reported more than 24 hours after receiving the product. Once the damage is reported provided that it is within 24 hours, we will contact the shipping carrier for inspection and provide you with further instructions. We will make every effort to resolve the damaged case as soon as possible.
Returns
For all returns, you must contact us in advance to obtain a Return Material Authorization (RMA) form. We reserve the right to reject any returned item that does not meet our guidelines. If we reject any returned item, you will not receive a refund on such item. You are responsible for all return shipping cost, and all shipping charges are non-refundable. Returning parts that do not have prior authorization will be rejected and you will be responsible for any costs to return the products to you. We accept authorized returns up to 30 days from your delivery date. Items that are custom-made products may not be returned. This includes any products with part number add-ons different from the SKU listed in our catalog. All parts that have been authorized for return must be received within 14 days after RMA was issued.  A 20% restocking fee applies to ALL parts returned unless you order a direct replacement. Refunds for all returned items may take up to 60 days to process after the returned item is received.
All returns must be in original packaging, unused, in re-sellable condition. Any items that are returned without the original packaging, with the genuine manufacturer label not intact, appear to be used, or are not in re-sellable condition will be returned to customer at customer’s expense. CUSTOM MADE PRODUCTS ARE NOT RETURNABLE.
Should you request that a replacement part be shipped at the time the return is requested, ImmersionLighting.com may request, in its sole discretion, payment for the replacement part.  Upon receipt of the returned item, the payment for the replacement part will be credited to you. If ImmersionLighting.com does not receive the item from you, you agree that you will be responsible for payment on both the item that was to be returned and the item that was shipped to you as a replacement.
Lost Orders
In the event that a product is lost in-transit or has not been delivered on the scheduled date, please notify us immediately. We will then contact the shipping carrier to place a tracer on the package. If the shipping carrier cannot locate the lost package, a claim will be issued. We can then re-order and ship out the replacements as soon as possible.
Incomplete Orders
We will make every effort to verify that all necessary components that come with a particular part or accessory are included. In the event that your part or accessory is missing a component, we will ship the missing component to you at no charge; unless that component is sold separately and not part of the original part or accessory. All claims for missing components must be made within 24 hours of receipt.
Warranties
ImmersionLighting.com makes no warranties, representations, statements or guarantees (whether express, implied in law or residual) regarding the Site or the products contained therein.  Should you purchase a product through the Site your only recourse for the product is the manufacturer’s warranty.
ImmersionLighting.com helps to facilitate the manufacturer’s standard warranty as a complimentary service to our customers for the products that we offer only.  ImmersionLighting.com does not offer a warranty of any kind and does not reimburse for labor, lift or equipment expenses, or any other expenses on any sale for any product. All product and manufacturer warranty claims will be strictly limited to the manufacturer’s written policies and warranty periods.
Use of Products
YOUR USE OF ANY PRODUCTS PURCHASED FROM THIS SITE IS AT YOUR OWN RISK.  IN NO EVENT WILL IMMERSIONLIGHTING.COM BE LIABLE TO YOU FOR ANY DAMAGES CAUSED BY THE USE OF PRODUCTS ON THIS SITE.  YOU UNDERSTAND THAT THE PRODUCTS YOU ARE BUYING THROUGH THIS SITE IF USED INCORRECTLY OR AGAINST THE RECOMMENDED USE MAY BE HAZARDOUS TO YOUR HEALTH OR SOMEONE ELSE’S.  YOU AGREE AND ACKNOWLEDGE THAT IT IS YOUR RESPONSIBILITY TO USE THE PRODUCTS IN A SAFE MANNER.  FURTHER, YOU AGREE AND ACKNOWLEDGE THAT USE OF ANY PRODUCTS MAY BE HAZARDOUS AND CAUSE SERIOUS PHYSICAL HARM OR EVEN DEATH.  YOU TAKE FULL RESPONSIBILITY FOR THE USE OF ANY PRODUCT YOU BUY THROUGH THIS SITE AND AGREE TO INDEMNIFY AND HOLD HARMLESS IMMERSIONLIGHTING.COM FOR ANY INJURIES OR DEATH CAUSED BY THE USE OF SUCH PRODUCTS.
Trademarks

By using the Site and/or purchasing products from this Site, you agree that the laws of the State of Oklahoma, without regard to principles of conflict of laws, will govern these Terms of Use and any dispute of any sort that might arise between you and ImmersionLighting.com.   You agree not to commence or prosecute any action in connection therewith other than in the state and federal courts of Oklahoma City, Oklahoma, and you hereby consent to, and waive all defenses of lack of personal jurisdiction and forum non conveniens with respect to, venue and jurisdiction in the state and federal courts of Oklahoma.
